Akron Stingray warrant denied over monthlong phone-sweeping plan

A federal magistrate rejected a 30-day cell-site simulator warrant that could have captured data from thousands of Akron phones.

A federal magistrate judge denied an Akron Stingray warrant after federal officers asked to run a cell-site simulator for up to 30 days, around the clock, in an effort to identify phone devices allegedly used by a criminal suspect in Akron, Ohio.

The ruling, reported by This Week in Security, said the proposed search could have exposed information from “thousands” of people who were not suspected of any crime. The judge said the request would have given federal agents too much discretion to monitor private citizens’ movements for a full month.

The ruling does not identify the federal agency that sought the warrant. It also does not describe the alleged crime. The remaining docket is sealed, so the public record is thin where it matters most.

Why did the judge reject the Akron Stingray warrant?

The judge found that the warrant failed the Fourth Amendment’s particularity requirement, which requires warrants to identify the place to be searched and the people or things to be seized. According to the ruling, probable cause tied the investigation to one person and one or more unknown phones, but the proposed method would have swept up identifiers and location-related data from many people in multiple places.

The application sought permission to use what the ruling called a canvassing cell-site simulator, or CCSS, 24 hours a day for as long as 30 days. The government listed five possible locations: the suspect’s residence, an overnight location, a daytime location, and two densely populated places the suspect reportedly visited often.

Federal officers said they would deploy the device when they had reason to believe the suspect was present and nearby, according to the ruling. The judge was not persuaded that this meaningfully narrowed the search.

What is a Stingray?

A Stingray is a cell-site simulator, a device that imitates a cellular tower so nearby phones connect to it and reveal identifying information. The technique can help investigators find a target phone, but it can also touch phones belonging to bystanders in the same area.

That bystander problem drove the court’s analysis. The ruling compared the request to rejected geofence warrants, where investigators seek data from many devices in an area and then work backward toward a suspect. The court cited a 2023 federal decision from Illinois rejecting a similar rummaging-style search, comparing it to searching an entire apartment building or city block when probable cause points to one unit.

The government also said it would not take further investigative steps until it determined which device belonged to the suspect, and that irrelevant information would be deleted. The ruling still treated the front-end collection as the constitutional problem.

Cell-site simulators have become less visible in recent years. The manufacturer L3Harris left the market for the devices, and changes in cellular technology made some collection harder. Court decisions also tightened the legal terrain: Riley required warrants for cell phone searches, and Carpenter limited warrantless long-term location tracking through cell-site records.

The Akron ruling shows that obtaining a warrant is not enough if the warrant describes a dragnet. The judge’s message was blunt in legal terms: officers cannot search thousands of phones for a month because they have probable cause about one suspect.
